Egyptian judge Refaat Al Saeed said that Egypt’s President has the right to ratify the agreement of the Council of Representatives on the delimitation of maritime borders between Egypt and Saudi Arabia, which requires the return of the islands of Tiran and Sanafir of the Kingdom.
He added, in an interview with “Arabs Today”, that the President, after his approval, orders that it be published in the Official Gazette, regardless of the judicial rulings in circulation, indicating that the president ends his role after ratification as long as he does not object to it and sends it back to the House of Representatives for review.
The only way for those who are refuse this agreement, he said, is to turn, through legal proceedings, to the Supreme Constitutional Court to challenge the law passed by the parliament. He added that the court has the sole right in the judiciary to correct the law or to violate it, The right to establish such a lawsuit.
He said that the Constitutional Court has the duty to adjudicate the case before it in relation to the dispute between two judgments issued by two different parties, which is required to determine the competent authority to hear the case in the judgment issued.
He added that The judgment issued shall not be restricted to the Constitutional Court in the case of the case of implementation and shall cease to effect as soon as the judgment in the dispute case is issued by the entire court. The final judgments issued by the administrative court and the court of urgent matters are not enforceable and are suspended.
