Egyptian former President Hosni Mubarak "It is illogical for the former president not to be aware of demonstrations taking place in 12 governorates, on January 25," Said Mustafa Suleiman, the Attorney-General and lead prosecutor, as part of his argument in the case of Egyptian former President Hosni Mubarak, his two sons, Alaa and Gamal, and former Interior Minister Habib El-Adli.
Suleiman pointed out that El-Adli, did not dare to give orders of firing, “without direct instructions from the former president." He explained, "the first defendant (Mubarak) said something very strange in the investigation that revealed his intentions, when he said that he stepped down from power as a result of the armed forces not carrying out what he entrusted of them.” The prosecutor wondered, what is the role that was assigned to the Army and has not been implemented?
Suleiman went on saying, "After the armed forces had been deploy, the attack on the demonstrators stopped," and, "Police Generals Mahmoud Wagdy and Mansour Al-Issawi, former Ministers of Interior have said during the investigation that, it is not the authority of the Minister of Interior to shot peaceful demonstrations unless after referring to the political leadership.”
Attorney General revealed that the Al-Adli had admitted in the investigation that he had referred to the president and gave him details of what was happening.  Mubarak, then, decided holding two meetings that ended in issuing instructions not to deal with demonstrators with violence.
Following the prosecution's argument in case of killing demonstrators, the court listened to the argument on the case of wasting public money, gas exports to Israel and the abuse of power. Attorney General ,Wael Hussein directed the defendants as employees at the Ministry of the Interior, and their mission to maintain the interests and state funds, whether public or private.
Hussein said that the chief of the State Security Investigation, Hassan Abdel Rahman has obtained information illegaly, which led to the inability of the police to face criminals, and resulted in prisons storming, smuggling prisoners, and the state lawlessness.
He also accused the former Interior Minister, and Security Chiefs of Cairo, Giza and October City, of not meeting "the needs of their job, and causing chaos, sparking panic and fear in the hearts of people, and that resulted in putting unarmed people in the face of thugs, and causing many serious physical damages that are the subject of the crime. "
Attorney-General Ashor Farag said in his argument that "Mubarak has squandered the country’s oil, which helped exploiter to claim it. He demonstrated Mubarak acts of corruption by investigations in the case of Bibliotheca Alexandrina. In which, it was revealed that he had hidden foreign donations received from several countries and the European Union, in the account only he can handle, and wasted EGP 398 million of state budget to build and equip library.
